Terms of Service

1. Acceptance

By creating an account, calling the API, or embedding any Arzan Hub component, you ("Tenant") agree to be bound by these Terms.

2. Service

Hub provides a multi-tenant communication platform: API and embeddable UI for managing messages across third-party channels (WhatsApp, Instagram, Messenger, Telegram, Green API and others). Hub is a processor of message data on behalf of the Tenant.

3. Acceptable use

You agree not to use Hub to:

• Send unsolicited messages (spam) or violate the recipient's consent.
• Violate third-party channel policies (Meta Commerce Policy, WhatsApp Business Messaging Policy, Telegram ToS).
• Distribute malware, phishing content, or content that exploits minors.
• Reverse-engineer, scrape, or attempt to access data of other Tenants.
• Resell raw API access without our written consent.

Violation may result in immediate suspension. We will give 24h notice when feasible.

4. Channel compliance

You are responsible for compliance with each connected channel's terms. Hub performs the technical integration but does not waive your obligations to Meta, Telegram, or other providers.

5. Fees

Hub is offered under the pricing posted on this site or in your contract. We reserve the right to change pricing with 30 days' notice for monthly subscribers. Annual subscribers keep their rate until renewal.

6. Data ownership

You retain all rights to messages, customer profiles, and other content you process through Hub. We claim no ownership. We may use aggregated, anonymised statistics (volumes, error rates) to improve the service.

7. Confidentiality

Each party agrees to keep the other's confidential information secret and use it only as needed to operate the service.

8. Warranties & liability

Hub is provided "as is" without warranties of merchantability or fitness for a particular purpose beyond what is required by applicable law. To the maximum extent permitted by law, our aggregate liability is limited to fees paid by the Tenant in the 12 months preceding the claim.

9. Termination

You may terminate at any time by closing your account. We may terminate for material breach with 7 days notice and an opportunity to cure, or immediately for repeated abuse or legal risk. On termination, we will export your data on request and delete it 30 days later.

10. Governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Almaty unless otherwise required by mandatory consumer-protection law.
